These Terms of Service ("Terms") govern your access to and use of the Selia Bot platform operated by Selia Bot ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to bind the business entity you represent. By registering, you represent that you have such authority.

2. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

Selia Bot provides an AI-powered sales agent platform that enables businesses to automate customer conversations, product recommendations, order processing, and WhatsApp messaging. The Service includes:

4. Subscription & Billing

Selia Bot offers a 14-day free trial. After the trial, you must subscribe to a paid plan to continue using the Service. Subscription fees are billed monthly. You may cancel at any time; access continues through the end of your current billing period.

We reserve the right to change pricing with 30 days' notice. Price changes do not apply retroactively to the current billing period.

5. Your Data

You retain all rights to the data you input into the platform (products, orders, customer information, conversations). We do not sell your data. We process it solely to provide the Service as described in our Privacy Policy.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws (including GDPR, if applicable) with respect to your end customers' data.

When you connect your WhatsApp Business Account through Meta's Embedded Signup, you agree to comply with WhatsApp's Business Policy and Commerce Policy. You are responsible for obtaining proper consent from your customers before messaging them. Selia Bot is not liable for actions taken by Meta against your WhatsApp Business Account.

8. AI-Generated Content

The AI sales agent generates responses based on your product catalog, knowledge base, and business configuration. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and configuring your agent's behavior. Selia Bot is not liable for any losses resulting from AI-generated responses.

9. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by third-party providers (Google Cloud, Meta, payment processors).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELIA BOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate these Terms at any time. You may cancel your subscription through the dashboard or by emailing us. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.

12. Changes to Terms

We may modify these Terms at any time. We will notify you via email or dashboard notification at least 30 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Republic of Panama. Any disputes shall be resolved through good-faith negotiation first, then through arbitration in Panama City, Panama.
